Rule 218
Auction Procedure

(1) Submit a report from a mechanical technician stating that the machines, tools and heavy equipment and vehicles (except horses, bicycles) in the local body are in current condition but are old models, lack of spare parts and cost more in maintenance and operation and are unusable in the current condition. If the authorized officer determines that the machine tools and heavy equipment and goods should be auctioned, the local body shall make a recommendation according to sub-rule (2) after examining and surveying such goods.
(2) If vehicles, equipment, machines or tools are to be auctioned, the concerned local body shall do as follows:-
(a) Under the chairmanship of the Secretary or an officer designated by him, a committee will be constituted consisting of a technical representative of the authorized level designated by the relevant local body and a representative of the authorized level designated by the Treasury and Accounts Controller's Office. But in the case of village development committee, the committee will be constituted with the chairperson of the village development committee, the secretary and the technical representative designated by the office of the district development committee.
(b) When appointing a technical representative, as far as possible, an employee with knowledge of the related commodity should be appointed.
(c) In the case of goods worth more than ten lakh rupees or special type of goods, the local body can invite up to two technicians of the related subject.
(d) According to sub-rule (4), if the price has not been determined after conducting the necessary study and survey, the committee will give a recommendation report to the local body, including the estimated price.
(3) After receiving the recommendation of the committee as per sub-rule (2), the entire Behora opening shall be submitted to the concerned local body.
(4) The committee under sub-rule (2) shall also consider the utility, service life, depreciation, residual value and market value of the goods while fixing the price of the unpriced goods. While deducting the depreciation, it should be deducted at the rate according to the prevailing law related to income tax. While maintaining the value of goods that have not paid customs duty, the customs fee should also be included and the fee should be deducted. soAnd in the case of goods that cannot be fully or partially delivered on the basis mentioned in this rule, the committee of sub-rule (2) should submit it to the relevant local body. After receiving the information in this way, the local body should ask the relevant experts to investigate whether the goods will be used or not. If the relevant expert gives a report that such goods cannot be reused after repair or if the repair is in accordance with sub-rule (14), instructions should be given to fix the price based on the same report.
(5) After submission of the recommendation as per sub-rule (3), the concerned local body may order the auction. After receiving the order, the Secretary will conduct the auction sale according to sub-rule (6).
(6) After receiving the order to auction according to sub-rule (5) or after the decision to auction according to sub-rule (1) has been given a deadline of fifteen days for auctioning goods up to one lakh rupees and twenty-one days for auctioning goods worth more than that, open notice including the following matters The auction should be promoted by publication:-
(a) Description of Goods,
(b) Minimum price of goods,
(c) the place, date and time (starting and ending time for the promotion) of the auction,
(d) Starting from minimum price,
(e) The fact that a cash bond of five percent of the bid bid should be kept before the auction is held and if the bid bid increases, the deposit should be increased in the same proportion,
(f) Period for collection of auctioned goods,
(g) Other essential matters.
(7) Notwithstanding anything written elsewhere in this rule, if it is deemed appropriate to sell the goods by auction, the buyer may arrange for inspection of the goods and call for bids by giving a deadline in accordance with sub-rule (6). If the bid is submitted in this way, a security deposit equal to five percent of the bid amount or a voucher deposited in the bond account must be kept with the bid. If the relevant local body deems it appropriate, it can arrange the procurement and filing of bids from any other local body.
(8) UpaniyaAccording to I (6) or (7) when publishing the notice to increase the auction or call for bids, if the pearl price is not revealed, the price of the goods will be fixed up to fifty thousand rupees during the current valuation and if the pearl price is opened, the price will be fixed up to one hundred thousand rupees when the pearl price is opened. Goods-related local bodies, district administration office, goods port office, treasury and accounting controller office and if there is any construction business organization in the headquarters of that district, also in the office of such organization, post a notice in a public place so that everyone can see it and get information about the bond or tax. It has to be done and if the price is higher than that, the notice should be published in the national level newspaper. And the goods whose price is lower than the mentioned price, the authorized officer shall post a notice in a public place so that everyone can see it in the relevant local body, district administration office, goods port office, treasury and accounting controller office and if there is any construction business organization in the headquarters of that district, also in the office of such organization. In this way, after receiving the information about the deposit or payment, the auction can be increased or the auction can be sold by asking for bids. In this way, if the auction cannot be sold for the first time, the notice should be published again after seven days.
(9) If the auctioned goods are not paid the full amount within the period specified by the relevant local body, the security deposit will be confiscated and re-auctioned.
(10) If the minimum price is not accepted even after raising the auction again, bye-law
(2) The auction should be increased by conducting a re-evaluation by the committee as per (2). If the auction cannot be increased even with the re-evaluated price, it can be sold directly in the name of the member designated by the concerned local body, district administration office and official level representative of the Treasury and Accounts Controller's Office. If it cannot be sold directly like this, action will have to be taken against Minha. But in the case of Village Development Committee, a representative of the nearest government office should be kept.
(11) Motor, tThe members of the evaluation committee who carry out the inspection and survey of vehicles such as trucks, jeeps and large machine tools will be given a meeting allowance at the rate set by the local body.
(12) Apart from vehicles, machinery, tools and technical goods, when valuing goods such as furniture, the value can be maintained on the basis of the depreciation cut-off rate prescribed for the purpose of income tax without forming a valuation committee. After the expiration of the life of any goods that have been fixed, the committee can price them and sell them by auction according to sub-rule (2).
(13) In order to get information about whether or not the auction has been sold in accordance with this regulation, the relevant local body must conduct an inspection once a year and take a report and take necessary action on such report.
(14) Notwithstanding anything written elsewhere in this regulation, the authorized officer may sell by auction on the recommendation of the committee under sub-rule (2) if the goods are more than twelve years old and not in current condition, or if the cost of repair is more than twenty five percent of the market value of the same goods to bring them to current condition.
(15) An item-wise cost estimate should be prepared for the cost of demolition and the proceeds from the sale of goods and materials during the auction sale of the constructed physical structures. If the amount required for demolition is more than the amount received from the auction sale, the auction reduction method should be adopted, considering the difference as the minimum price. If the amount received from the auction is more than the cost of demolition, the difference should be taken as the minimum price and the auction should be increased.
